In tlus?etter the Division voiced its concerns on the
installation of these bulkheads and expressed the information we felt was necessary before we could feel
comfortable with the bulkheads. At the time, based on conversations with your attorney and legal
representative,it was the Division's belief that we would begin a dialogue relative to coming to agreement
relative to our concerns. To date,we have not been contacted to begin such a dialogue nor have we been
updated on the activities of the Corporations relative to the bulkhead installation.
As previously stated, the Division is concerned with the possible water quality impacts that could occur
from the installation of the bulkheads. Therefore,we are requesting that we be updated in writing on the
status of the installation of the bulkheads as well as the status of water quality monitoring at the site.
Some of the questions we would like addressed are: Are the seeps being surveyed and monitored this
year? Are the bulkheads to be installed this summer? If so,what is the schedule for installation? Has the
monitoring program been revised per our concerns? Has the bromide been introduced into the mine?
In addition,we would be interested in any additional monitoring data which was gathered subsequent to
your previous submittal to the Division. Please submit this update by June 1. If the Corporations are not
interested in entering into a dialogue with the Division,we would appreciate being so advised.
The Division would like to again stress that we are willing to work with Sunnyside and Echo Bay to
resolve these issues. We suggest that you contact us to arrange a meeting so that we can begin a dialogue
on resolving the issues. Please contact me at(303)692-3608 set up such a meeting or with any
questions.
