Box 921 <br /> Carbondale, Colorado <br /> 81623 <br /> RE: Coal Basin Mine <br /> Dear Mr. Mechau: <br /> I have received your April 7, 1997 letter regarding funding of the Coal Basin <br /> reclamation project. I would like to respond to your concerns. <br /> I am sorry that you have misunderstood our response of March 14, 1997. The <br /> Divisions' primary goal has always been to reclaim the Coal Basin Mine to the best of <br /> its ability using available funds. The Division has never recanted the position it took <br /> during the litigation against Mid-Continent. I have reviewed our past correspondence, <br /> and I can not determine how your interpretation of our letter could have been arrived <br /> at. I certainly hope that this interpretation has not been represented to the public as <br /> the position of the Division, as it is quite inaccurate. <br /> As you are aware, the District Court, among other things, recognized that the Division <br /> had access to funds made available through the Mid-Continent Resources bankruptcy. <br /> Thus far, these funds have been sufficient to preform reclamation. The Division has <br /> had sufficient funds to conduct two full seasons of reclamation. We currently hold <br /> funds sufficient to accomplish the reclamation work scheduled for 1997. We are still <br /> in the process of determining the scope of work to be accomplished in 1998. We will <br /> inform you of 1998 funding availability when our planning is completed. When the <br /> Division can prove the funds from bankruptcy are depleted and are insufficient to <br /> complete satisfactory reclamation, it will consider all available options to obtain the <br /> required funding. <br />
