Long. <br /> The Crystal Valley Environmental Protection Association (CVEPA) continues to be <br /> extremely interested in the complete reclamation of the areas affected by mining in <br /> Coal Basin.We have been monitoring the work that theDivision has been doing under <br /> the supervision of Steve Renner, who is crying to do as much as possible with the <br /> limited funds available through the bankruptcy proceeds. <br /> Regarding the reclamation funds, please inform us: (1) How much of the $3 million <br /> assigned to the Division according to the liquidation plan has been accounted for? <br /> (2) How much money has the Division received to date? (3) How much has the Div- <br /> ision spent ? (4) How much does the Division have on hand? (5) What funds, if any, <br /> proceeding from the liquidation of Mid-Continent's mate and earmarked for reclama- <br /> tion, are in the control of Mid-Continent or the trustee for the bankruptcy action? <br /> Even if the reclamation project goes better than expected, substantially more than <br /> $3 million will be needed to stabilize and reclaim the disturbed areas. On this pant, <br /> the Division In its suit against John A. Reeves, Diane and Robert Delaney, and Mid- <br /> Continent Minerals took an emphatic and affirmative position. We were disappointed <br /> that in Dec. the appeal of an adverse District Court ruling was dismissed The decision <br /> of the Appeals Court, however, held that the Division is not precluded Nfrom exercis- <br /> ing its regulatory"arity ..." under Dept. of Natural Resources Rule 3.04,2(6), 2 <br /> Code Co. Reg. 407-2)to seek recovery of the full cost of reclamation. We therefore <br /> urge that the Division exercise its regulatory authority and use all legal means to re- <br /> cover from the responsible parties the substantial additional funds needed for ade- <br /> quate reclamation, Flood and landslide hazards which pose a serious threat -- as <br /> well as massive erosion and pollution problems— must be dealt with property. <br /> Please lot me know what actions, If any, the Board and the Division have taken in <br /> this regard and-what actions are planned, <br /> Thank you for your attention to thew matters.
