APR 10 '97 02:34PM DIV/MINERALS&GEOLOGY P.2/3
CRYSTAL VALLEY ENVIRONMENTAL PROTECTION ASSOCIATION, INC.
n.-.v n. . nnnrti.rrti.incfr faann o,c
, e
APR 10 N7
Michael Long April 7, 1997
Director Fjivwmn of cieogv
Div. of Minerals and Geology
1313 Sherman St., Rm. 215
Denver. Co. 80203
Re: Inadequacy of reclamation funds for Coal Basin
site .... ...
Dear Mr. Lang:
I received your letter of March 14, 1997 in reply to the letter I sent to you
earle:r in March, (i would have responded sooner. but was recently out
of town.
We appreciate the information about the environmental audit. the ass-
urance of availability of Steve Renner to appear at meetings and con-
duct tours of the site. and the assurance that we wdlf be notified of the
meeting of the MLR Board planned for August in Glenwood Springs,
but with regard to what is most important,i.e.,the need for the Division
to seek additional funds to assere complete reclamation of the mine
site in Coal Basin, we find the division's position to be irresponsible.
According to your letter, apparently the Division will simply wait until
if runs out of its dwindling funds, shut down reclamation operations,
and "then the Mined Land Reclamation Board will determine the best
course of action". We are astonished that the Divison has reversed it-
self regarding the insufficiency of $3 million and has (topped its commit-
meet 1which it made with considerable pubkc fanfare at the time the
kablility suit was brought) to assess responsible officials of Mid-Con-
tinent for the full costs of reclamation inducing costs in excess of
$3 mklion.lt is a matter of record that daring the pendancy of that suit.the
Division's project manager maintained that the redamation cost would
substantially exceed $3 mik'ion. In the face of the tremendous amount of
work that remains to be done to stabilize and revegetate road embank-
ments, trine benches and 4alnages to the point of achieving erosion
control, why is the Division ndt pursuing the additional muchimeded
funds?
In order to come to gips with and clarify Oft ima former. CoUin infor
mation is needed. You failed to answer the fret question of my previous
letter. " How much of the $3 miNion assigned to the Division according
to the 10dation plan has bcen accounted for?"-In-addition to-an,*we r-
