(MCR) holds Special Use <br /> Permits from the Forest Service for mine service and haul roads in <br /> IWAL Basin, Pitkin County, to serve the coal mines . These roads <br /> date back to the mid-1950s with subsequent changes and <br /> modifications over the years. <br /> A substantial concern has arisen recently over, what <br /> agency exerts primary jurisdication over environmental matters <br /> concerning the roads. As you know, for the last several weeks, an <br /> intensive survey has been performed in a cooperative effort as <br /> between the Forest Service and the Mined Land Reclamation Division <br />�Ef 3 1989ncerning sedimentation control, revegetation and other matters of <br /> WF�1F-SO concern about these roadways. <br /> suPR Between Tuesday, <br /> y, August 27 and the following Friday, Ms . <br /> Pas Donna Griffin of the Office of Surface Hiring conducted an <br /> F—P3 T inspection of tha mine site including the roads on the forest. <br /> +5'A <br /> (J'P'A Two 10-day notices were issued to the MLRD, copies <br /> F;;; attached, with directions for immediate implementation of various <br /> activities, includingroad grading, <br /> g g, reveg etation and the like. <br /> h. <br /> ffN -- We are in the process of complying <br /> f ;�a Pwith these <br /> requirements as best we can, but are not at all certain that they <br /> rL <br /> will conform to the directions of the Forest Service, or that they <br /> SlA meet Forest Service regulations . <br /> We respectfully request that you intervene to establish <br /> -E`er a more coordinated and orderly procedure with respect to inter- <br /> Si <br /> �:� �� agency inspection and enforcement. <br />
