cubic yards of refuse will be cut from the Old Refuse Pile. This material will be transported to the <br />vicinity of the Wash Plant to be stacked upon the concrete rubble generated from the facilities <br />area demolition. <br />Division contractors will accomplish the concrete demolition and disposal in the early summer of <br />1998 via a separate contract. You may recall that burying the concrete rubble with coal refuse <br />was described in some detail in the Mid - Continent Resources permit application at Volume 8 <br />Chapter V, Section D. 3. Thus, demolition and disposal of the concrete foundations, and burying <br />them beneath coal refuse is a part of the permit. <br />The Division's accounting of January 23, 1998 did not contain a cost for burying the concrete <br />rubble with coal refuse. This is because it is the Division's intent to accomplish coverage of the <br />concrete rubble at no cost to Resources as a result of excavating material from the Old Refuse <br />Pile and placing it on the rubble. The cost of burial would be paid through completion of the <br />Huntsman Project with Abandoned Mined Land funds, rather than from the Reclamation Fund <br />under Resources liquidation plan. Completion of this project as envisioned will therefore result in <br />a substantial savings to Mid - Continent Resources. However, if for some reason the project <br />cannot be accomplished, the Division would amend its accounting to include a cost for burial of <br />the demolished concrete, since the cost would not be expended pursuant to the AML project. <br />The task of burying the concrete would instead be funded through the liquidation plan. <br />In order to ensure the feasibility and success of the project, we will need to utilize topsoil to cover <br />the cut slope at the refuse pile. Given the need for the project and the savings to Mid - Continent <br />Resources, the Division would like the written permission of the Creditors Trustee to utilize the <br />topsoil stockpiled near the eastern terminus of the former overland conveyor. The volume of <br />topsoil estimated in the Mid - Continent Resources permit to be in this stockpile should be <br />sufficient to accomplish this project. If the Trustee does not allow for the use of this material, the <br />Huntsman Project may not be viable, and any projected savings to the Reclamation Fund as a <br />result of accomplishing the project would not be realized. It is our estimation that the volume of <br />topsoil left in the Sutey stockpile is sufficient to accomplish reclamation of the mine facilities area, <br />without relying upon the material at the overland conveyor location. <br />CC: Michael Long <br />David Bucknam <br />Jim McArdle <br />c: \sgr\hntltrmc.wpd <br />
