OLOR 11 \ \F. <br />\1I <br />`I` .PRI \1 ,, COLOR .1002 <br />June 24, 1998 <br />Attached is copy of letter sent to Michael Long of the <br />Division of Minerals and Geology concerning transfer of Mid - <br />Continent Resources real estate to Midcon Realty LLC, including <br />the remainder of the Prep Plant tract in Coal Basin. <br />As previously stated, the preferred objective will be <br />to transfer the remainder of the Prep Plant tract to the United <br />States at such time as reclamation has been completed in a manner <br />acceptable to the Forest Service. <br />Because of settlement negotiations with DMG, the trial <br />date of August 7, 1998 in the case pending in the District Court <br />of Pitkin County between Mid - Continent, the Trustee, and DMG has <br />been vacated. <br />In the immediate future, a meeting will be scheduled <br />with the Water Quality Division of the Colorado Department of <br />Health to discuss the sedimentation ponds in Coal Basin. A <br />schedule is attached showing the NPDES Discharge Permit numbers. <br />Although Mid - Continent has been out of possession since 1994, and <br />mining ceased in January, 1991, the permits are still outstanding <br />to Mid - Continent as permittee. <br />The Reclamation Plan provides for removal of the ponds, <br />which would terminate the point source discharges.
