Although CVEPA repeatedly sought to have the responsible <br /> agencies impose the necessary erosion controls required by law, <br /> and in spite of numerous citations for failure to control <br /> drainage, maintain settling ponds and so forth, MCR under Robert <br /> Delaney greatly succeeded in using economic and political <br /> influence to deter compliance or significant penalties. As is <br /> well known, MCR left DMG with a specious reclamation bond which <br /> forced DMG to seek reclamation funds through the liquidation plan <br /> of the bankruptcy court. <br /> After all this and after having imposed on the public tens <br /> of millions of dollars of debt (see the bankruptcy court file) , <br /> it now remains to be seen whether MCR's owners and agents can <br /> succeed in protecting their own substantial assets and impose the <br /> further costs of reclamation upon the public. <br />
