The purpose of <br /> this reclamation project is to construct a naturally functioning stream to replace the failing Dutch <br /> Creek Flume. The flume is deteriorating on a yearly basis, and will fail in the future. Such a <br /> failure may cause Dutch Creek to flow through old coal refuse, thus resulting in degradation of <br /> the quality of Coal Creek and of the Crystal River. To avoid this risk, the Diversion Project will <br /> result in creation of a permanent, stable stream channel in a location which approximates the <br /> original position of Dutch Creek before it was routed through the flume structure. A 404 permit <br /> has been issued by the Army Corps of Engineers for construction of the new channel. <br /> The Diversion will be constructed in the vicinity of the former Wash Plant location. Runoff <br /> water from the Wash Plant vicinity and adjacent areas currently flows to the 001 pond system. <br /> The 001 pond, which discharges to Coal Creek immediately below its confluence with Dutch <br /> Creek, is addressed by an active NPDES permit held by Mid-Continent Resources. <br /> Construction of the Dutch Creek Diversion will result in a bisection of the 001 pond contributing <br /> area. The portion of the 001 pond contributing area located to the east of the planned Dutch <br /> Creek Diversion will continue to report to the pond system. The area west of the Diversion, and <br /> drainage from a portion of Road A for a distance of about 300 feet above the Wash Plant, will no <br /> longer report to the pond. This drainage will report to Dutch Creek within the newly constructed <br /> channel, as routing of the water generated from this area to the 001 pond will no longer be <br /> possible. <br /> Drainage from the area west of the Diversion which would have reported to the 001 pond will be <br /> treated and released into Dutch Creek as non-point sources using a variety of best management <br /> practices. Silt fencing will be constructed adjacent to and parallel with the Dutch Creek <br /> Diversion in order that sediment is not transported from the site. Up-gradient of the silt fence <br /> two to three long, shallow excavations may also be constructed. The excavations will be <br /> constructed so that the eastern bank or margins are constructed on-grade so that water may flow <br />
