MCR asserts that the 017 outfall at Mine 5 no longer receives mine water although it did
in the past. DMG has not been able to confirm whether 017 receives mine water or not. In the
event that CDPHE acknowledges that the 017 pond does not receive mine water, DMG agrees to
reclaim the 017 pond and to apply for a stormwater permit for that pond.
