OSM finds DMG has provided accurate and appropriate documentation of administrative, <br /> enforcement, and civil actions brought to date by DMG against Mid-Continent Resources and its <br /> agents; accurately documented reclamation history and ongoing reclamation activity at Coal <br /> Basin; and accurately characterized the Court of Appeals ruling as noted above. Given the <br /> documentation provided, OSM finds it is neither necessary to perform an independent estimate of <br /> the cost of completing full reclamation at the Coal Basin site nor to independently file suit <br /> against Mid-Continent Resources, the Delaneys, and Reeves as you suggested. OSM reserves <br /> the right to independently file suit against Mid-Continent Resources and its officers or agents if <br /> OSM determines it is necessary to do so as the current bankruptcy, liquidation proceedings, and <br /> reclamation of the site progress. <br /> If you do not agree with these findings, you have the right under 30 CFR 842.15 to request an <br /> informal review. Your request should contain statements of how you may be adversely affected <br /> and why you feel these findings merit the informal review.
