Box 2115 Michael B.Long <br /> 1001 Grand Avenue, Suite 106 Division Director <br /> Glenwood Springs, Colorado 81602 <br /> RE: Coal Basin Mine Reclamation <br /> Dear Ms. Delaney: <br /> We are in receipt of your correspondence dated March 6, 2002. <br /> The Division has completed the reclamation work specified in Exhibit B to the <br /> Settlement Agreement. On March 6, 2002, the Division executed a notice <br /> releasing the MidCon property from further reclamation obligation. On March 7, <br /> 2002 the notice was provided to the attorneys involved in the litigation. A <br /> courtesy copy of the notice is attached. <br /> Although the Settlement Agreement does not contain a provision requiring <br /> disclosure of the status of reclamation work on public lands and a corresponding <br /> release of financial information, we will provide such to you. In general, the <br /> Division has not yet completed all remaining reclamation tasks in Coal Basin. <br /> Some amount of earth work, vegetation establishment, weed control, erosion <br /> control and maintenance work remains to be completed on Public lands. <br /> Approximately $300,000 remains in the reclamation account. <br /> As you note, the Settlement Agreement at Section 18 provides a mechanism for <br /> a release of further reclamation obligation at the former Load Out facility. As <br /> described in Section 18 of the Settlement Agreement, the Division will provide <br /> the release subsequent to MidCon LLC completing the reclamation work <br /> described therein. Please provide us with a letter which states that all of the <br /> reclamation tasks described in Section 18 have been completed. Following <br /> receipt of the letter, we will conduct a site inspection. Assuming the inspection <br /> reveals that the work described in Section 18 has been satisfactorily completed, <br /> we will provide the release document. <br />
