Permit C-81-017. <br /> Dear Mr. Mathews: <br /> In your letter of January 15, 1992, concerning vacation of NOV C- <br /> 91-018, you indicated that the division requires certain revisions <br /> to the permit, to be filed as an amendment to our previous request <br /> for Permit Revision 3. <br /> PR-3 addresses the maintenance program for the former haul roads if <br /> the mine remains in operation, and this amendment is intended to <br /> address an interim program for an active mine. I do not believe it <br /> is suitable, nor do I offer it to apply, if the mine is permanently <br /> closed and final reclamation begins. <br /> In your letter, you indicated that " . . . it is the Division's <br /> determination that the permit conditions which allow for continued <br /> sloughing of cut-and-fill slopes are no longer appropriate. . . . " <br /> Revision to pages 17, 21 , and 22 of Chapter 5 have been prepared <br /> and are enclosed as Attachment 1. Reference to sloughage of the <br /> slopes has been removed. <br /> The notice of violation had specified, as abatement, that the <br /> operator should again attempt to establish vegetative cover in <br /> those areas along the road which have sufficient soil to allow for <br /> potential growth, or to take other measures to control sediment to <br /> the extent possible. <br /> Mid-Continent did obtain seed and mulch for the purpose of <br /> attempting to vegetate areas of soil on the road cuts. Early <br /> snowfall prevented the effort last fall. <br /> The revision as proposed 12/91 addresses the effort to establish <br /> vegetative cover along roads at page 19(d) , but does not establish <br />
