Specifically, you raised a concern <br /> regarding the availability of public access to the area which lies between <br /> Colorado State Highway 133 and the Coal Basin Mine adjacent to the Coal Creek <br /> Access Road. We appreciate your contacting us, and would like to take this <br /> opportunity to respond. <br /> The majority of the Coal Creek access road lies outside of the boundary of the <br /> permit issued by our Division to Mid-Continent Resources. As such, issues <br /> regarding the post-reclamation use of the road fall outside of our <br /> jurisdiction. This means that we are legally unable to impose conditions <br /> regarding the use of this land upon Mid-Continent. We will , however, <br /> incorporate your concerns to the extent possible into our current discussions <br /> with Mid-Continent Resources and all involved parties. We wish to ensure that <br /> reclamation of the disturbance within the State Permit boundaries coincides <br /> with uses of adjacent lands, both public and private. <br /> Thank you for bringing your concerns to our attention.
