Specifically, you raised a concern
regarding the availability of public access to the area which lies between
Colorado State Highway 133 and the Coal Basin Mine adjacent to the Coal Creek
Access Road. We appreciate your contacting us, and would like to take this
opportunity to respond.
The majority of the Coal Creek access road lies outside of the boundary of the
permit issued by our Division to Mid-Continent Resources. As such, issues
regarding the post-reclamation use of the road fall outside of our
jurisdiction. This means that we are legally unable to impose conditions
regarding the use of this land upon Mid-Continent. We will , however,
incorporate your concerns to the extent possible into our current discussions
with Mid-Continent Resources and all involved parties. We wish to ensure that
reclamation of the disturbance within the State Permit boundaries coincides
with uses of adjacent lands, both public and private.
Thank you for bringing your concerns to our attention. We welcome
participation from all interested individuals, associations and corporations.
Please do not hesitate to contact me for any further assistance I may provide.
Sincerely,
Steven G.
