Subsequent to that <br /> approval, the Board revoked the permit. You had then requested that the Mined Land Reclamation Board <br /> reconsider the Division's decision, citing several concerns which you felt needed resolution. <br /> The Division and Mid-Continent will soon initiate negotiations regarding revisions to the reclamation plan <br /> and schedule. The concerns which you cited which are pertinent to reclamation of the Coal Basin Mine will <br /> be open for consideration during negotiations. Assuming that the negotiations are successfully concluded, <br /> the Division will propose a decision. At that time, should you decide that your concerns have not been <br /> resolved, you could request that the Board hear your case and alter the Division's decision. It is my feeling <br /> that this process is more appropriate for resolving these issues, rather than appealing the previous revision <br /> approval, particularly in light of the permit revocation. <br /> I would anticipate that Mid-Continent would submit a revised reclamation plan within the next two weeks. <br /> This submittal would initate the negotiations. The plan should be finalized by the first of the year. <br /> I hope that this correspondence accurately summarizes our conversation.
