- 2 - <br /> Comments on Findings <br /> I . Legal , Financial and Compliance Information - Rule 2 .03 <br /> On June 11 , 1985 David C. Shelton, then Director of the CMLRD issued a <br /> determination of pattern of violations to the Coal Basin Mines . A subsequent <br /> show cause order was issued to the Coal Basin Mines. Subsequently the <br /> Colorado Mined Land Reclamation Board suspended the mining permit for the Coal <br /> Basin Mines No. C-81 -017 for one day on September 25, 1985 as punitive action <br /> for the pattern of violations occurring during the period of September 22 , <br /> 1983, and October 30, 1984. <br /> In the last 3 years the following violations have been issued to Coal Basin <br /> Mines <br /> NOV DATE ISSUED REGULATION CITATION ABATEMENT DATE <br /> C-86-071 10/30/86 4.05.1 12/19/86 <br /> C-87-026 6/26/87 4.06.4 (2 ) (d ) 7/22/87 <br /> C-87-027 6/26/87 4.03.2 (6 ) (b ), <br /> 4.05.6(3) (d) 9/24/87 <br /> C-87-028 6/26/87 4.11 .4 7/22/87 <br /> C-88-021 4/22/88 4.03.3 (6) (a) 5/18/88 <br /> C-88-022 4/22/88 4.09.1 6/23/88 <br /> All these violations have been abated and terminated. The Division has <br /> reviewed these violations and finds that no pattern of violation exists. <br /> 'therefore, the operation continues to be in compliance with the requirements <br /> of this section. <br /> II. Land Use - Rules 2.04.3, 2.05.5 and 4.16 <br /> There is no change in the land use section of the permit. The applicant plans <br /> to reclaim the disturbed areas to a post-mining land use of rangeland, <br /> wildlife habitat, and recreation, which are consistent with pre-mining land <br /> use. <br /> II. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br /> No change is required to this section of the findings <br /> IV . Geology - Rule 2.04.5 and 2 .0 4.6 <br /> No change is required to this section of the findings. <br /> tt . Surface Water Hydrology - Rules 2.04.5, 2.04.7, 2.05.3 (4) , <br /> and 4.07 <br />
