NOTICE OF PROPOSED DECISION The Colorado Mined Land Reclamation Division proposes that an application to renew a valid, existing permit to conduct coal mining and reclamation operations submitted by the Mid-Continent Resources, Inc. for the Coal Basin Mines be approved with conditions. The Coal Basin Mines operation is located in Pitkin, Garfield and Gunnison Counties, approximately 4 miles west from Redstone, Colorado. The mine is an underground mine with an anticipated maximum production capacity of 2.5 million tons per year. The coal to be mined is privately and federally owned, and the surface to be affected is privately and federally owned. The permit area encompasses approximately 11 ,384.0 acres in Sections 31 and 32, T9S, R89W; Sections 4-11 , 14-21 , 28-30, T10S, R89W; Section 36, T9S, R9OW; Sections 1-2, 11-14, 23-25, T10S, R90W; Section 35, T7S, R88W; all in the 6th P.M. in Pitkin, Gunnison, and Garfield Counties, Colorado. This proposed approval decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 , et seq. , and the regulations promulgated thereunder. Copies of the proposed decision including stipulations, are on file for public inspection at the Colorado Mined Land Reclamation Division, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at the County Clerk' s Office at the courthouses of Pitkin, Garfield, and Gunnison Counties. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made within thirty (30) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the proposed decision. 1161G
