The tunnel became operational only after September, 1987, and our short operating <br /> history had not indicated whether additional pond capacity would, in fact, be <br /> needed. <br /> We had permitted for the ponds as a prudent step, but in applying for the Technical <br /> Revision, Mid-Continent did not submit a schedule for completion of the ponds, made <br /> no commitment as to schedule, nor was one required. ( Technical Revision No. 5, <br /> issued October 16, 1986). <br /> Mid-Continent first submitted a commitment to construct Pond D ( by September, <br /> 1989) as part of our request for Technical Revision 11. <br /> MLRD stated in a letter dated March 30, 1989: <br /> The Division accepts the proposal to construct Pond D in September, 1989. <br /> That is the only commitment under the approved permit to a schedule for construction <br /> of any of the approved additional ponds. The permit document contains multiple <br /> references to the additional tunnel ponds, without commitment as to the time of <br /> construction. <br /> As part of the permit review, which went on throughout 1988, Mid-Continent changed <br /> various pages in our original submittal which contained typos, misstatements or <br /> mistakes. Had the reference to construction, which was inaccurate during the time of <br /> permit review, been noted, it would have been corrected. As permit application is quite <br /> voluminous, this misstatement was not noted and corrected at the time.
