Shelton, Director <br /> Colorado Mined Land Reclamation Division <br /> 423 Centennial Building <br /> 1313 Sherman Street <br /> Denver, Colorado 80203 <br /> Dear Mr. Shelton: <br /> The Office of Surface Mining Reclamation and Enforcement (OSMRE) has <br /> completed its initial review of the requests dated December 17, 1985, for <br /> revisions to Mid-Continent Resources, Inc. 's Coal Basin Mine Permit. The <br /> proposed boundary revision includes the addition of Federal surface and <br /> Federal coal and, therefore, constitutes a mining plan modification in <br /> accordance with 30 CFR 746.18(d)(4) and will require approval by the <br /> Assistant Secretary for Land and Minerals Management. <br /> The Bureau of Land Management has also reviewed the proposed revision, <br /> and has approved the modification to the resource recovery and protection <br /> plan with the stipulations that: <br /> 1. The approval of the revised resource recovery and protection <br /> plan be confined to the currently approved permit area until a <br /> permit revision incorporating the additional Federal lands is <br /> issued. <br /> 2. Subsequent panel development in the Dutch Creek No. 2 Mine <br /> adjacent to panels 206 and 207 shall take place as close as <br /> possible to the rock split encountered during development of <br /> panels 204 and 206. <br /> In addition, Mid-Continent Resources, Inc. , needs to submit data on the <br /> average annual depletion of surface flows in the Upper Colorado River <br /> Basin due to the mining and reclamation at the Coal Basin Mine. <br /> OSMRE has determined that the technical revision for subsidence <br /> monitoring deletion does not constitute a mining plan modification under <br /> 30 CFR 746.18, therefore, this revision may be approved under the terms <br /> of the cooperative agreement. It is our understanding that Mid-Continent <br /> was asked to withdraw the technical revisions for a road extension, rock <br /> tunnel extension and methane gas drainage wells by your office. <br /> Therefore, OSMRE will not take any action on these proposed revisions <br /> until they are resubmitted to us through Colorado Mined Land Reclamation <br /> Division. <br />
