<br />Dear Mr. Gubka:
<br />The Division received WFC's application for Minor Revision No. 84 (MR -84) on May 25, 2012.
<br />The application was found Incomplete on June 4, but determined to be Complete on June 6, 2012
<br />with the submittal of a cover letter of explanation.
<br />A Soil Sampling and Analysis Plan (SAP) was developed in 2011 to evaluate the properties of
<br />undisturbed, stockpiled, and redistributed soils on the Morgan property. This SAP was approved,
<br />and incorporated into the New Horizon Mine permit under TR -61 on November 21, 2011.
<br />Sampling of the soils was conducted on November 22 and December 12 -14, 2011. Certain
<br />modifications to the approved SAP were made in the field; TR -62, which was approved on April 4,
<br />2012, provided formal documentation of the sampling process and the changes made in the field.
<br />The purpose of MR -84 is to incorporate the field data and analytical results into the permit. All
<br />technical documents associated with the SAP are found in Section 2.04.9, Attachment 2.04.9 -10.
<br />WFC contracted with Key Agricultural Services, Inc. (Key -Ag) to prepare the SAP and to conduct
<br />the field operations. Soil samples collected during the sampling efforts were analyzed by Key -Ag's
<br />laboratory. Preliminary data was provided by WFC, as it became available, for distribution to the
<br />various interested parties (DRMS, OSM, NRCS, and Morgan family). The initial reported values
<br />for EC were unexpectedly high. In a letter dated April 17, 2012, Key -Ag explained that this was
<br />due to machine calibration error. The samples of soil were re -run, and corrected EC values were
<br />provided.
<br />The Division has reviewed the MR -84 application for adequacy; a list of the items which require
<br />your attention is provided below:
