7.Page 2.05-41 states that “Markers will be installed in Pond F clearly indicating the required
sediment cleanout level and maximum water level that could occur while still allowing ample
storage for the design event.” BRL will need to verify that the markers reflect the sediment
and water levels approved with this revision. A response from BRL is not required.

The diversion ditches around the refuse expansion area will need to be completely
constructed and lined (rip rap) prior to placement of any refuse beyond the currently
constructed diversion ditches. Care should be taken to ensure that rip rap selection and
placement in the ditches is consistent with the notes on Figure 3 (Pond F Detail); specifically,
the rip rap needs to be well graded to ensure that voids are filled. A response from BRL is
not required.

Rule 4.05.6(4) and 4.05.9(2)

Item Resolved.
8.

Item Resolved.
9.

Rule 4.05.3(7)(b)

Item Resolved.
10.

Rule 4.10.4(2)

Division Response:
11. BRL responds that a cut slope of 1.5H:1V should be considered stable,
just as it would be allowed for a road cut. The difference in this case is that should a failure
occur, cleaning of this ditch will be much more difficult than cleaning of a roadside ditch
would be. The proposed slope will be acceptable, under the condition that BRL conducts
inspection (and cleaning, if necessary) of the ditch on a regular basis. It is critical that flow
never be diverted onto the surface of the Gob Pile. A response from BRL is not required.

The Division calculated a reclamation cost estimate for the expansion of gob pile #2 as proposed in
TR-72. The increase in liability for TR-72 is $18,135.11. The mine’s current liability is
$9,069,867.82 and bond held is $9,155,156.00 (the difference is $85,288.18). Please review the
attached cost estimate and inform the Division if the estimate is acceptable.

If you have any questions, please contact me.

Sincerely,

Brock F.
