CO-0027529 and CO-0036056 <br /> San Juan County <br /> Dear Mr. Perinos <br /> After conversations with you and with Jim Stevens of the Colorado Division of <br /> Minerals and Geology (CDKG), and after reviewing the Division files, we have <br /> determined that a decision on whether to authorise moving the discharge point for <br /> the American Tunnel permit (00-0027529) must be delayed until the CDKQ approves <br /> the hydraulic plugs. They have informed us that as part of their review process, <br /> they will review geological and hydrological information submitted by you with <br /> your design report in order to ensure that AU sources of water from your <br /> property will be permanently eliminated when the plugs are installed. They have <br /> indicated that they will not approve the project unless they are convinced that <br /> no water will be able to discharge down the tunnel from your property after the <br /> plugs are in place. it appears after talking with CDMG that if the plugging <br /> project is approved by them, it may also fully address our oancerM and <br /> therefore, relocation of the discharge point would likely be appropriate. <br /> As I am sure you are aware, some similar projects at other sites have not shown <br /> to be successful on a long term basis; therefore, until such time as this project <br /> is approved and we are satisfied with the review process, a decision from us <br /> regarding relocation of the discharge point would be prsmaturs. Additionally, <br /> you are probably aware that a reasonable period would be required after the plugs <br /> have been installed to demonstrate the long term success of this particular <br /> project prior to consideration of inactivation of your CDP8 permit. <br /> We will keep your amendment request on file and make a decision regarding moving <br /> the discharge point for permit CO-0027529 when CDMG approves the plugging. <br /> You expressed concerns about possibly violating the date for compliance with your <br /> whole effluent toxicity (waT) acute limitation due to a delay in completion of <br /> the plugging past June, 1993. You have stated that it is your goal to acheive <br /> compliance through cessation of all discharge. This course of action appears <br /> acceptable. <br />
