Box 158
Carbondale, Colorado 81623
Re: Variance From Stream Buffer Zone - File No. C-017-81
Dear Mr. Bowman:
I have reviewed your request for a variance from the 100 foot buffer zone
requirement at the rock tunnel disposal area. The Division agrees with your
statement that changing the Dutch Creek stream channel just to maintain a 100
foot buffer zone between the stream and the waste pile would be more
detrimental to the environment than allowing disposal less than 100 feet from
the present stream channel. Therefore, the Division approves a variance from
the 100 foot buffer zone requirement in accordance witn Rule 4.Ob. 18.
Since you are requesting a change in the permit, the Division must treat this
as a minor revision. The form approving tnis revision is enclosed. To aid
the Division in keeping the permit application current, please submit the
appropriate page and map changes or additions for three copies.
Mid-Continent must erect stream buffer zone markers along the edge of the
proposed disturbed area to comply with Rule 4.05.18.
If you have any questions, please call.
Sincerely,
0 —
JiT Herron
Reclamation Specialist
JH/mab
Enclosure
Doc.
