prohibition established under this article or <br /> federal law on quantities, rates, and <br /> concentrations of chemical, physical, <br /> biological, and other constituents which are <br /> discharged from point sources into state <br /> waters, including, but not limited to, <br /> standards of performance for new sources, <br /> toxic effluent standards and schedules of <br /> compliance. <br /> (31) "',POINT SOURCE" means any discernible, <br /> confined, and discreet conveyance, including, <br /> but not limited to, any pipe, ditch, channel, <br /> tunnel, conduit, well, discreet fissure, <br /> container, rolling stock, concentrated animal <br /> feeding operation, or vessel or other floating <br /> craft, from which pollutants are or may be <br /> discharged. "Point Source" does not include <br /> irrigation return flow. <br /> CONSIDERATION FOR SMALL AREAS <br /> Effluent limits, which are established for control of point source <br /> discharges into state waters, are not applied to non-point source <br /> run-off. As a practical matter, these effluent limits can be <br /> applied to a point source only when there is sufficient flow to <br /> allow for a sample to be taken and analyzed. It should be noted <br /> that the sample is taken at the point of discharge to state waters. <br /> None of the areas which are the subject of this technical revision <br /> includes a point source, as defined by the applicable regulations, <br /> in that none has a discernible, confined and/or discreet <br /> conveyance. Moreover none of these areas typically sustains flows <br /> sufficient or concentrated enough to allow for samples against <br /> which to apply effluent limits. Further, all areas except the end <br /> of the berm behind the bath-house, are at a distance from waters of <br /> the state (i.e. Coal Creek and its tributaries) so there is no <br /> discharge attributable solely to these areas against which to apply <br /> effluent limits. <br /> Certainly no applicable effluent limitation nor requirement for <br /> downstream receiving waters is violated or exceeded by run-off from <br /> the areas which are the subject of this request for technical <br /> revision. <br /> The effluent limits which are applicable to a point source <br /> discharge below a sediment pond (016) have been compared, using the <br /> 5 <br />
