Delaney: <br /> The Division is proposing to approve Technical Revision No. 20 based on the <br /> reasons set forth below. ) <br /> The technical revision application includes a demonstration that the disturbed <br /> surface areas are small , ia provision for sediment control measures including <br /> berms, strawbale checks, and seeding and mulching, and a commitment to monitor <br /> discharge, when it occurs in measurable volume, from six identified small area <br /> exemption sites which were included in Notice of Violation C-90-052. <br /> Small area exemption designation was not requested as a part of the <br /> Technical Revision No. 201 application for two sites included in Notice of <br /> Violation C-90-052. First, lumber was stored adjacent to the South Fork of <br /> Dutch Creek at the base of Road C. The lumber has been removed . The site was <br /> not otherwise disturbed by mining activity and no further disturbance is <br /> proposed . Second, sediment control berms and catchment basins at the Sutey <br /> topsoil stockpiles had breached. The basins have since been cleaned out and <br /> the berms repaired. The berm/basin system was approved via Minor Revision <br /> No. 17 on June 28 , 1989. <br /> Pursuant to Rule 4.05.2(3�(a) and (b) , the Division grants the requested small <br /> area exemptions based on the applicant' s demonstration that sediment ponds are <br /> not necessary for the drainage to meet the effluent limitations of Rule 4.05.2 <br /> and applicable state and federal water quality requirements . The disturbed <br /> surface drainage area is small (cumulative total of less than 1 . 5 acres for <br /> the six areas and there is no mixture of surface runoff with underground mine <br /> discharge . The operator has committed to a monitoring plan to document the <br /> effectiveness of proposed sediment controls relative to applicable effluent <br /> standards .
