Broetzman, Acting Designee of the Executive Director of the Colorado Department of Health This Petition for Imposition of Civil Penalty ( "Petition" ) is addressed to vou, pursuant to section 25-8-608 ( 2 ) , C.R. S . ( 1982 ) , in your capacity as Acting Designee of the Executive Director of the Colorado Department of Health . You are author- ized thereby to deterlmine civil penalties upon application of the Division of Administration of the Colorado Department of Health . Authority to apply for imposition of a civil penalty in this mat- ter has been delegated to me by the Executive Director of the Department . 1 . Mid-Continent Resources , Inc. ( "Mid-Continent" ) owns and operates the Coal' Basin Mines ( " the mines" ) located in the SW 1/4 of sec . 11 , T10S,' R89W, about 4 1/2 miles west of Redstone , Pitkin County, Colorado . 2 . In connection with its operation of the mines , Mid-Continent operates a wastewater treatment system, which is the subject of the Colorado Discharge Permit System Permit No. CO-0000396 , issued October 20 , 1982 and scheduled to expire on June 30 , 1987 . Under the terms of the permit , there are 21 authorized points of discharge associated with the treatment sys- tem. 3 . The Water' Quality Control Division ( " the Division" ) issued a Notice of violation ( " the Notice" ) and a Cease and Desist Order ( " the Order" ) to Mid-Continent on November 20 , 1984 , for a discharge contalining pollutants , occurring on May 3 , 1984 ,
