It is not clear <br /> whether vour question was whether the areas described fell under the <br /> "Small Area Exemption" or if we aqreed that the sources were not point <br /> sources. There is not adequate information supplied to answer either <br /> question. <br /> In order for the Division to make a determination, a description of the area <br /> must me submitted. The tons of sediment appear low, however I do not feel <br /> comfortable making a decision on such limited information relative to the <br /> Small Area Exemption. Concerning whether such areas are non-point <br /> sources, additional information is also needed. The definition of point <br /> source is so broad that a decision may not be possible without a site visit. <br /> At a minimum a topographic map and a description of the area is needed. It <br /> should not be assumed that if an area falls under the "Small Area Exemption" <br /> it is a non-point source. <br /> It is assumed that part of the reason for your questions may be the new <br /> NPDES stormwater regulation. I have included a copy of the regulation for <br /> you information. Also included is a document which describes the <br /> industries impacted by the regulations. The last two pages discusses point <br /> sources. <br />
