-53- <br /> THE PERMITTEE SHALL SUBMIT THE REPORT OF THE GEOTECHNICAL INVESTIGATION <br /> AND STABILITY ANALYSIS, THE DETAILED MATERIAL BALANCE, AND A DETAILED <br /> PORTAL BENCH RECLAMATION PLAN TO THE DIVISION FOLLOWING THE SCHEDULE -- <br /> PAGE 21 .2 'OF CHAPTER V, VOLUME 7 OF THE APPLICATION. <br /> The application includes the construction of a rock tunnel to be used to haul <br /> coal from the No. 1 and No. 2 mines to the base of the steep slope portion of <br /> the Basin's road system. This tunnel will allow discontinued hauling of coal <br /> by truck along the upper road system, which will greatly decrease impacts upon <br /> the Coal Basin environment and significantly reduce hazard exposure for the <br /> truck drivers and other mine personnel . The rock tunnel and its associated <br /> 320,000 cubic yard waste pile was reviewed and approved as a technical <br /> revision during 1979 and 1980. The approval of the tunnel and its associated <br /> underground development waste pile stipulated the installation of ground water <br /> monitoring wells in and adjoining the refuse pile. The application has been <br /> amended, in response to Division requests in the Preliminary Adequacy Review, <br /> to include monitoring results collected to date and to state the company's <br /> intent to conform with the original stipulations. The rock tunnel refuse pill <br /> is, therefore, in compliance with satisfactory resolution of the stipulation. <br /> The temporary fill over the large Dutch Creek culvert at the rock tunnel will <br /> be removed and the material will be placed on the cut of the tunnel face-up. <br /> This area will be graded to approximate original contour, then topsoiled to a <br /> depth of 12 to 16 inches. �r <br /> The applicant submitted information on backfilling and grading of the <br /> preparations plant area in response to a stipulation in the original findings <br /> document. This response did not meet the requirements for approximate <br /> original contour. This is evidently due to the proposed ski area post-mining <br /> land use (see Section II of this document), which calls for retention of much <br /> of the surface facilities area at the preparations plant. However, since the <br /> applicant cannot presently meet the requirements for a post-mining land use <br /> change, a backfilling and grading plan for the facilities area meeting the <br /> requirements for approximate original contour is necessary. Since no further <br /> disturbance of the facilities area is planned and reclamation will not occur <br /> until cessation of mining, this topic is amenable to stipulation. The <br /> Division finds that the following stipulation is necessary to make a finding <br /> of compliance with the backfilling and grading requirements: <br /> Stipulation No. 7 <br /> THE PERNITTEE SHALL SUBMIT A BACKFILLING AND GRADING PLAN, INCLUDING <br /> CROSS-SECTIONS AND MAPS OF THE PROPOSED POST-MINING CONTOURS, FOR THE <br /> PREPARATIONS PLANT AREA TO THE DIVISION FOR APPROVAL BY DECEMBER 31 , <br /> 1984. THE PERMITTEE MUST OBTAIN DIVISION APPROVAL OF THE BACKFILLING <br /> AND GRADING PLAN AND THE PERMIT APPLICATION MUST SUBSEQUENTLY BE <br /> UPDATED TO INCLUDE THE APPROVED BACKFILLING AND GRADING PLAN BY MARCH <br /> 29, 1985. <br />
