Compliance With Mine Plan <br />N - Support Facilities Not On -site <br />R - Other <br />N - Special Categories Of Mining <br />N - Processing Waste <br />R - Topsoil <br />COMMENTS <br />This was a complete inspection of the Terror Creek Loadout conducted by Jim Stark of the Colorado Division of <br />Reclamation, Mining and Safety. No representative from Terror Creek, LLC was present on the inspection. The <br />operation was not actively processing or loading coal at the time of the inspection. The weather was warm and <br />sunny and the ground was dry. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />- All of the necessary records were at the loadout office. Please see the "Availability of Records" form at the end <br />of this inspection report for more detailed information. One record was found to be out of date. The insurance <br />certificate expired on 1 June 2012. This was brought to Jim Kiger's attention and a new insurance certificate was <br />received on 12 June 2012. <br />HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6, Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />- Pond 1 was dry at the time of the inspection. The pond embankment was well vegetated and stable and no <br />erosional problems were noted. <br />- The dugout pond was dry at the time of the inspection. This is an incised pond and the area of the pond was well <br />vegetated and stable. No erosional problems were noted on the inslopes of the pond or the surrounding area. <br />- The ditch along the entrance/haul road and the ditch to the north of the coal stockpiles were both clean at the time <br />of the inspection. There was very little sediment in these ditches and no erosional problems were noted in any of <br />the ditches. <br />- All of the culverts at the site were clear at the time of the inspection. <br />GENERAL MINE PLAN COMPLANCE: <br />- The Terror Creek Loadout is a loadout only. Operations at the site include processing coal (sizing coal) and <br />loading trains.
