His comments are <br /> enclosed. <br /> Concerning the subsidence plan, Dr. Pendleton has recommended that several <br /> stipulations be imposed on the permit. In order to simplify the permitting <br /> process, Mid-Continent should revise the subsidence monitoring section of <br /> Chapter 4 to include a commitment mimicking the wording of Stipulation 1 as <br /> detailed in Dr. Pendleton's enclosed memo. <br /> Dr. Pendleton's recommended Stipulation No. 3 concerning subsidence has <br /> already been covered by Mid-Continent's commitment on page 37 of <br /> Chapter 4 to provide a monitoring program plan acceptable to MLRD prior to <br /> implementation of the multil ft longwall technology. <br /> Stipulation No. 2 requires a reassessment of the extent of the potentially <br /> subsided area and impact based upon the 1988 subsidence survey. This needs to <br /> be committed to by Mid-Continent within the narrative on subsidence. More <br /> specifically, the statement on page 37 , extracted from Dr. Pendleton 's earlier <br /> memo, stating that the 18 decree angle of draw and .30 as the subsidence <br /> factor is no longer valid ba ed on the new survey. <br /> Regarding the landslide on the No. 3 road, Mid-Continent's proposal is <br /> acceptable and narrative should be included in the permit to describe the <br /> proposed plan. <br /> The reclamation plan for the portal area is also acceptable.
