Pineda <br />Director <br />Re: Lorencito Canyon Mine, C1996 -084, Fourth Quarter 2011 Corrected Sediment Pond <br />Inspection Reports <br />Dear Mr. Thompson: <br />The Division received New Elk Coal Company's corrected 2011 Fouth Quarter Sediment Pond <br />Inspection Reports for the Lorencito Canyon Mine on February 23, 2012. The reports have <br />corrected the pond inspection date to December 29, 2011. This correction is acceptable. <br />Annual Certification for sediment ponds was conducted in December 2011 according to the <br />reports. The Division has yet to receive the Annual certification reports for the Lorencito <br />sediment ponds. Please submit this report to the Division promptly in accordance with Rule <br />4.05.9(14). <br />The corrected 2011 Sediment pond inspection reports meet the requirement of Rule 4.05.9(17). <br />Please be reminded that the Division has not yet received the 2012 First quarter sediment pond <br />inspection from New Elk Coal Company, LLC.
