T <br /> Agencv or Department Name <br /> COLORADO DEPARTMENT OF <br /> PUBLIC HEALTH AND ENVIRONMENT <br /> Department or Agency Number <br /> FAA <br /> Contract Routing Number <br /> 00-00279 <br /> INTERAGENCY CONTRACT <br /> This INTERAGENCY CONTRACT is made this 20th day of July, 1999,by and between:the State of Colorado, for <br /> the use and benefit of the COLORADO DEPARTMENT OF PUBLIC HEALTH AND EVIRONMENT,whose <br /> address or principal place of business is 4300 Cherry Creek Drive South.Denver,Colorado 80246-1530, <br /> hereinafter referred to as"CDPHE";and,the State of Colorado,for the use and benefit of the COLORADO <br /> DEPARTMENT OF NATURAL RESOURCESIDIVISION OF MINERALS AND GEOLOGY,whose address <br /> or principal place of business is 1313 Sherman Street,Room 215,Denver,Colorado 80203,hereinafter referred to <br /> as"CDNR/DMG". <br /> WHEREAS,as to the CDPHE,authority exists in the Law and Funds have been budgeted,appropriated,and <br /> otherwise made available and a sufficient uncommitted balance thereof remains available for subsequent <br /> encumbering and payment of this Interagency Contract in Fund Number 100,Appropriation Account 205,and <br /> Organization Number 2023,under Contract Encumbrance Number W000000279; <br /> WHEREAS,The CDPHE has been awarded a grant under Section 319(h)of the Federal Clean Water Act to <br /> implement nonpoint source water quality improvement projects in the State of Colorado;and, <br /> WHEREAS,the Coal Basin Nonpoint Source Watershed project is a high priority for the State's nonpoint source <br /> program;and, <br /> WHEREAS,the made date of this Contract,the CDPHE has a currently valid Group II purchasing delegation <br /> agreement with the Division of Purchasing withing the Colorado Department of Personnel;and, <br /> WHEREAS, section 29-1-201, 8 C.R.S., as amended,encourages governments to make the most efficient and <br /> effective use of their powers and responsibilities by cooperating and contracting with each other to the fullest extent <br /> possible to provide any function,service,or facility lawfully authorized to each of the cooperating or contracting <br /> entities, and to this end all State contracts with its political subdivisions are exempt from the State's personnel rules <br /> and the State procurement code;and, <br /> WHEREAS,the Contractor has proposed a project which has been approved by the CDPHE and the United States <br /> Environmental Protection Agency("USEPA");and' <br /> WHEREAS,the Contractor has arranged for the necessary matching contributions to the grant;and, <br /> WHEREAS,all required approvals, clearances,and coordination have been accomplished from and with all <br /> appropriate agencies. <br /> NOW THEREFORE, in consideration of their mutual promises to each,stated below,the parties mutually agree <br /> that: <br /> Page I of 10 <br />
