If the legal problems are not resolved in favor of the <br /> State, the project will have to be canceled or postponed further. Currently there is no set time <br /> frame that I can give you for resolution of the legal issues. <br /> You have the following options regarding this project; <br /> 1. Determine that you do not want this project with all of the unknowns that exist. We will then <br /> cancel the project and rebid it at a future date. <br /> 2. Determine that you do want to keep this project award effective until next summer's <br /> construction season. If the project proceeds, construction would be scheduled for September. <br /> There is no guarantee that the project will be done in the summer or fall of 1999, if ever. <br /> a. We will need a commitment that the project would be completed for the price as bid. <br /> b. The State will continue to retain the bond. <br /> Please provide me with a letter addressing which option you would like to proceed with, <br /> including your commitments, if item 2 is chosen. <br /> We apologize for any inconvenience that this postponement may have caused you.
