White top (Cardaria draba) and Tamarisk (Tamarix sp.) were observed within the Pond B area. <br />These weeds are considered noxious weeds and will need to be treated prior to the approval of the site <br />release. Section 2.05.4(2)(e) of the permit includes a weed control plan for these species. Honeywood <br />will need to conduct the approved weed control measures in this area and provide documentation to the <br />Division these species have been treated. This could include photographs and herbicide receipts. <br />Rule 3.03.2 Re -Seed Sediment Pond A <br />4.) Sediment Pond A has been reclaimed, however the primary vegetation observed in this area was <br />Russian Thistle (Salsola australis). Several grass species were observed such as Bottlebrush Squirreltail <br />(Sitanion hystrix) and Indian Ricegrass (Oryzopsis hymenoides) but these species were sparse. The <br />Operator will need to re -seed the Pond A area with the approved seed mix in the fall prior to the <br />approval of the site release and provide the Division with documentation (seed receipt) this work has <br />been completed. <br />Perimeter Fence Removal <br />5.) The perimeter fences surrounding the revegetation areas are still in place and will need to be <br />removed prior to the Division's approval of the site release. Mr. Rich indicated the landowner of the <br />mine area may desire to retain a portion of the fence for his personal use on the property. If so, the <br />Operator will need to submit a minor revision to the permit to include a provision to leave all or a <br />portion of the fence in place. A letter from the landowner must be submitted indicating they desire to <br />leave fencing in place in accordance with Rule 2.05.5(1)(b). <br />This concludes the Division review of the Surety Release (SL3) application. In accordance with Rule <br />3.032(5)(a) the Division is required to issue a decision on the release by July 29, 2012. If you need <br />additional time to address these issues, the Operator will need to request an extension of the decision <br />date prior to July 29, 2012.
