06/06/2012 08.34 FAX 19708823030 970 -864 -2119 <br />June 06, 2012 <br />Ms. Marcia Talvitie <br />Department of Natural Resources <br />Division of Reclamation, Mining and Safety <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />Dear Ms. Talvitie, <br />On both sides of my family, I come from many generations of hard rock underground, open pit <br />and strip coal, gold, silver, uranium /vanadium, potash miners as well as the oil and natural gas <br />industry. <br />I am a sixth generation Coloradoan, five generations being here in Nucla. My Great- great- <br />grandfather Charlie Rice being a hard rock miner from Central City and Durango, CO, moved to <br />the Nucla area to help build and construct the Colorado Cooperative Company's Ditch, (with his <br />mining expertise, the longest tunnel was dug by and was named after him) to provide water to the <br />three parks making up the Nucla community. <br />My Grandfather Charles (Andy) Guire (grandson to Charlie) was employed by Edna Coal <br />Company, then later Peabody Coal Company, in which he mined through, removing coal from <br />under much of the family property on second park. <br />I am in full support of mining of any sort, so long as it is performed in a professional, <br />constructive and ecological manner that is a win -win situation for the land, wildlife, investors, <br />mining company, land owner(s), not to mention the general public. <br />With the observation and current experience in dealing with Western Fuels — Colorado, LLC and <br />in reviewing DRMS rules and regulations, I hereby formally object and protest Western Fuels <br />Permit No. C -2010 -089. I feel that Western Fuels should be held accountable to their current <br />obligations and responsibilities or lack thereof. <br />I would be in support of DRMS delaying the final ruling and issuance of the New Horizon North <br />mining permit until Western Fuels has dealt with and cleaned up the reclamation and legal issues <br />they are currently involved with pertaining to NI-12 and Permit No. C- 1981 -008. <br />if the New Horizon North mine is issued them mining permit, then Western Fuels has no <br />incentive but to preclude a speedy resolution of current issues if they are allowed to move <br />forward with new mining operations. <br />Thank you for your time and consideration! <br />JUN 062012 <br />Division of Reclamation, <br />Mining & Safety <br />Sent Via Fax to: 303 -832 -8106 <br />RE: Objection to Western Fuels — Colorado, LLC Permit No. C -2010 -089 <br />0001/001 <br />
