Pineda <br />Director <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, <br />Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on June 8, 2012 an <br />application to revise coal mining operations at the West Elk Mine was considered complete for the <br />purposes of filing. The revision was submitted by Mountain Coal Company, LLC. All review and <br />comment periods as provided in the Act and the Regulations initiate from this date of filing. <br />Mountain Coal Company, LLC has submitted a Technical Revision to the West Elk Mine's Permit. <br />The revision is to incorporate as -built drawings and engineering reports into the permit to reflect <br />the repair work completed on the slumps at the RPEE haul road and the stacker tune 2 pad. This <br />work was in an existing disturbed area and an area that already has reclamation liability attached to <br />it. Therefore, there will be no increase in disturbed area or reclamation liability associated with <br />this revision. This revision also includes design changes to the drainage for the RPEE and <br />additional monitoring for the RPEE. <br />The Underground coal mining operation is on land located approximately 9 miles East of Paonia, <br />Colorado. The permit area is further described as follows: <br />All or portions o£ Sections 9 through 36 (inclusive), Township 13 South, Range 90 West; Sections <br />23 through 26 (inclusive), Township 13 South, Range 91 West; and Sections 1, 2, 3, 4, 8, 9, 10, 11, <br />and 12, Township 14 South, Range 90 West; all of the 6th Principal Meridian.
