Subject: Recommendation for Approval of the Coal Basin Mines in
Plan, as
Modified, Mid-Continent Resources, Pitkin County, Colorado, Federal
Lease(s) : C-012457, C-011646, C-09004, C-09005, C-0115606,
C-0125436, C-030345, and C-012640
I recommend approval of the Coal Basin mines mining plan, as modified,
subject to the Mineral Leasing Act of 1920, as amended. My recommendation
to approve the Coal Basin mining plan modification is based on: (1)
Mid-Continent Resources's complete permit application package (PAP), as
updated through November 27, 1985, (2) review of the PAP by the State as
required by the Colorado State Program and cooperative agreement, (3) review
of the complete operation and reclamation plan portion of the permit
application by the Office of Surface Mining Reclamation and Enforcement, (4)
the Federal lands review pursuant to section 522(b) of the Surface Mining
Control and Reclamation Act of 1977 (SMCRA), (5) comments and
recommendations or concurrence of other Federal agencies, including the
findings and recommendations of the Bureau of Land Management with respect
to the resource recovery and protection plan and other requirements of the
lease and the Mineral Leasing Act of 1920, as amended, (6) compliance with
the National Environmental Policy Act of 1969, and (7) documentation
assuring compliance with applicable requirements of other Federal laws,
regulations and executive orders.
The Secretary may approve a mining plan, as modified, for Federal lands
under 30 U.S.C. 207(c) and 1273(c). I find that the proposed operations
will be in compliance with all applicable laws and-. regulations, and I
recommend the Coal Basin mines mining plan modification updated through
November 27, 1985, be approved.
The Coal Basin mines mining plan approved on. July 29, 1983, along with this
mining plan modification is reflected in the proposed.-mining plan approval
document included with this memorandum. Becauaw. the Secretary of the
Interior and the State of Colorado have entered. into a cooperative agreement
which provides for the delegation to the State_of� the permitting
responsibilities for operations on Federal lands pursuant to Section 523 of
SMCRA, the previously issued Federal permit will be dissolved upon approval
of this mining plan, as modified.
