be performed at the direction of the permittee, without any
relief to the permittee of the statutory and regulatory
obligations imposed upon it.
The Division, through the Office of the Attorney General, has
monitored the flow of cash collateral to Pitkin Iron through
bankruptcy court. The cash collateral has been used exclusively
to pay the expenses incurred by Pitkin Iron in performing
reclamation of the site. There is no appearance that the agents,
owners or controllers of Resources or Pitkin Iron have profited
from Pitkin Irons' performance of reclamation. The Division
continually monitors the reclamation work at the site by
conducting frequent inspections during the construction season.
The Division believes that the employment of Pitkin Iron by Mid-
Continent Resources to accomplish reclamation of the mine site is
supported by State and Federal statute and regulation, as well as
the Mined Land Reclamation Board May, 1991; January, 1992 and
May, 1992 Orders. Therefore, the Division of Minerals and
Geology has appropriately implemented the approved program.
-17-
