PART II <br /> Page 7 of 16 <br /> Permit No: CO-0039136 <br /> A. MANAGEMENT REQUIREMENTS <br /> 1 . Change i'n Discharge <br /> All discharges authorized herein shall be consistent with the terms <br /> and conditions of this permit. The discharge of any pollutant <br /> identified in this permit more frequently than or at a level in <br /> excess of that authorized shall constitute a violation of the permit. <br /> Any anticipated change in discharge location, facility expansions, <br /> production increases , or process modifications which will result <br /> in new, different, or increased discharges or pollutants must be <br /> reported by submission of a new NPDES application or, if such changes <br /> will .not violate the effluent limitations specified in this permit, <br /> by notice to the State Water Quality Control Division of such changes. <br /> Process modifications include, but are not limited to, the introduction <br /> of any new pollutant not previously identified in the permit, or any <br /> other modifications which may result in a discharge of a quantity or <br /> quality different from that which was applied for. Following such <br /> notice, the permit may be modified to specify and limit any pollutants <br /> not previously limited. <br /> 2. Noncompliance <br /> (A) Definitions _ <br /> (1) Upset: An exceptional incident in which there is unintentional <br /> and temporary noncompliance with technology-based permit <br /> effluent limitations because of factors beyond the reasonable <br /> control of the permittee. <br /> (2) Bypass: The intentional diversion of waste streams from any <br /> portion of a treatment facility. <br /> (3) Severe Property Damage: Substantial physical damage to property, <br /> to the treatment facilities to cause them to become inoperable, or <br /> substantial and permanent loss of natural resources which can <br /> reasonably be expected to occur in the absence of a bypass. It <br /> does not mean economic loss caused by delays in production. <br /> (B) Notification <br /> (1) If, for any reason, the permittee does not comply with or will be <br /> unable to comply with any maximum discharge limitations or <br /> standards specified in this permit, the permittee shall , at a <br /> minimum, provide the Water Quality Control Division and EPA with <br /> the following information: <br /> a) A description of the discharge and cause of noncompliance <br /> b) The period of noncompliance, including exact dates and times <br /> and/or the anticipated time when the discharge will return to <br /> compliance; and <br /> c) Steps being taken to reduce, eliminate, and prevent recurrence <br /> of the noncomplying discharge. <br /> 1/91 NON FEEDLOT ' <br />
