Colorado MLRD granted small area exemptions <br /> for these areas because they are small and there is no mixture <br /> of surface drainage with that from the disturbed surface areas. <br /> (See page 16 of TA) <br /> 3) There are several disturbed areas within the Coal Basin permit <br /> that are within the 100 foot buffer zone of Dutch Creek and Coal <br /> Creek. The existing rock tunnel disturbance, portions of travel <br /> roads A, B, and D, and a disturbance at the preparation plant <br /> are within 100 feet of Dutch Creek. The preparation plant is <br /> also within 100 feet of Coal Creek. With the exception of the <br /> rock tunnel disturbance, all disturbance within 100 feet of <br /> Dutch Creek and Coal Creek was in place prior to the enactment <br /> of SMCRA. Colorado MLRD granted a variance from the 100 foot <br /> buffer requirement. The applicant has committed to the <br /> restoration of stream channels to their approximate premining <br /> condition and Colorado MLRD has made the determination that <br /> water quality and quantity will not be affected by any of the <br /> disturbances. (See page 22 of TA) <br /> 4) Mid-Continent requested permission to monitor the subsidence <br /> network three times each summer. Quarterly monitoring, as <br /> required normally, is precluded in Coal Basin by rugged terrain, <br /> deep snowpack and extremely harsh winter weather conditions. <br /> Colorado MLRD, after inspections regarding this concern, agreed <br /> and granted the variance. <br /> 5) Mid-Continent has requested a variance from approximate original <br /> contour (AOC) requirements based upon steep slope mining <br /> conditions. The majority of the surface facilities disturbances <br /> for roads and mine portal benches exist in areas of original <br /> slopes greater than 200. The U.S. Forest Service has stated <br /> that they want certain roads left for access. The applicant has <br /> requested that these areas be returned to various postmining <br /> topographic configurations. Some may differ from AOC. The <br /> request was deemed appropriate by Colorado MLRD, but additional <br /> data and details are needed and were stipulated. The applicant <br /> is in the process of providing the information. (See special <br /> condition Nos. 6 and 8 on 1984 Colorado MLRD decision package) <br /> The public was notified of the availability of the PAP for review by <br /> publication of newspaper notices for four consecutive weeks ending <br /> December 25, 1985. No public comments on the PAP were received <br /> after the public notice was published. <br /> A technical analysis of the proposed mining and reclamation <br /> operations for the life-of-mine was prepared by Colorado MLRD for <br /> Permit Revision No. 1.
