Box 177 <br /> Silverton, CO 81433 }� <br /> RE: Sunnyside Mine <br /> Dear Mr. Perino: <br /> Your letter dated August 11, 1993 to Mr. David Nelson, Water commissioner at our <br /> Durango office has been re-directed to our office for a response. You propose to install four <br /> reinforced concrete bulkheads to impound water currently passing through the American Tunnel <br /> and the Terry Tunnel in the referenced mine. This will reduce the flow from the former and <br /> eliminate it from the latter tunnels. You wanted to know if any water rights would be injured by <br /> this change. <br /> Water from American Tunnel flows to Cement Creek which is not over-appropriated. <br /> There is one conditional water right (Conaway Pump) for 0.5 CFS on the Cement creek. Since <br /> there will be sufficient water available in the Cement Creek after the closure of the American <br /> Tunnel to meet the demand of the conditional water right, this will not cause any injury to the <br /> water right. <br /> Water from Terry Tunnel flows to Eureka Creek which is not over-appropriated. No water <br /> rights exit on the Eureka Creek. Both Cement Creek and Eureka Creek are tributaries to the <br /> Animas River which is not over-appropriated.
