f
r
WELBORN DUFFORD BROWN 8 TOOLEY, P.C.
Mr. J. David Holm
May 26, 1993
Page Five
geologic conditions . Under the recent storm water permit
regulations, once mined areas have been successfully reclaimed
and released from reclamation, storm water permit requirements
do not continue. Would the same be true with respect to all
NPDES permit requirements? These questions have previously
been submitted to Pat Nelson by Larry Perino ' s letter of
April 27, 1993 , and its enclosures .
We would be happy to meet with you to discuss these
matters further, but need decisions in order to determine
whether or not plugging remains a feasible reclamation
approach. While each circumstance creates "legal issues" , we
continue to feel Sunnyside Gold' s plans are the best
reclamation solution, and that perpetual treatment will not be
acceptable. Plugging will only be feasible if long-term
permitting and treatment are not continuing obligations. We
look forward to your early response to these questions, since
they will be vital in determining what path reclamation will
take, and how the Division of Minerals and Geology can approach
final reclamation permitting.
Very truly yours,
WELB RN DUFFORD BROWN & TOOLEY, P.C.
William C.
