To: <br />From: <br />Subject: <br />Date: <br />Zach — <br />Rule 4.05.3 <br />Zach Trujillo <br />Rob Zuber W 1 <br />New Elk —TR -65 Review <br />6/1/2012 <br />The following issues need to be addressed by NECC. <br />Interoffice Memorandum <br />I have reviewed the New Elk TR -65 application in the context of the following rules: <br />• 2.05.3(c) Roads <br />• 2.05.3(4) Impoundments <br />• 2.05.6(3) Protection of the hydrologic balance <br />• 4.03.1(4) Haul road drainage <br />• 4.05.3 Upland diversions, conveyance ditches <br />• 4.05.9 Impoundments - all applicable parts, but specifically 4.05.9(2)(e) and 4.05.9(7) <br />• 4.05.13 Surface and groundwater monitoring <br />• 4.10.3 Water control measures on coal mine waste banks. <br />Rule 2.05.3(c) <br />The proposed roads on Map 14 in TR -65 require clarification. In particular, the roads needed to build the proposed <br />DWDA and the Soil Storage Stockpile may have to be altered from the submitted map. It is unclear how these features <br />will be constructed. <br />Rule 2.05.3(4) <br />Please advise how potential subsidence, and impacts on Containment #2, will be addressed (see Rule 2.05.3(4)(a)(i)D)). <br />In addition to inspections of the pond, will this area be included in subsidence surveys? <br />Rule 2.05.6(3) <br />NECC must provide a plan for controlling runoff once it flows through ditch D49 and onto the Parks and Wildlife <br />property. Inclusion of this agency in future decisions will be necessary. <br />Also related to ditch D49, a SEDCAD printout is unclear. In the time of concentration details (page EXH 19(22) -49), there <br />are two times listed for SWS #2 for Structure #2: 0.055 hour and 0.377 hour. Please explain. It would be very useful (but <br />not necessary) to provide a schematic and /or map showing structures, sub - watersheds, and flow paths for D49 and <br />other ditches. <br />The location where ditch D49 would originate was inspected on May 1, 2012. The Division will need more details on the <br />design of the upper end of this ditch to determine if it is sufficient to prevent flow down the drainage from impacting <br />the proposed DWDA. Also, an access road will be needed for maintenance. <br />
