clay slurry which will harden into a brittle, compact clay. That is why it so suited <br />for clay lining of a reservoir. We also have someone who is going to purchase a <br />fair amount (2500 cubic yards) for lining/sealing an irrigation ditch. See attached <br />photos numbered 1 through 6. The photos and captions show and describe the <br />current condition of the shale. It has formed a brittle crust which is fairly <br />impenetrable by normal wind and water erosive events. This crust precludes water <br />and especially, wind erosion completely. It is best to leave this pile alone until it <br />can be used in the reclamation process. <br />2. Possible Violation: Large shale stockpile in the floodplain that is not part of the <br />mining plan. <br />Corrective Action: Approval from the local floodplain administrator for <br />stockpiles in the floodplain. <br />This corrective action has been negated. All the shale stockpiles and most of the <br />product stockpiles from mining and processing at this site are out of the 100 -year <br />floodplain of Boulder Creek. Stockpiling at a mine site is a temporary activity <br />and would not ever be a permanent feature at this location. <br />3. Possible Violation: Excavated shale from reservoir construction stockpiled on the <br />site that is not part of the mining plan currently on file with the DRMS <br />Corrective Action: The operator will file an amendment to the permit that will <br />clarify the mine plan and account for the excavated shale stockpile and other <br />aspects of the mine plan. <br />The corrective action due date for this plan amendment is May 31, 2012. Due to <br />the complexity of this required amendment and the short time -frame given, ASCI <br />will not be able to submit the amendment application by the due date (as <br />currently envisioned as of today's date). ASCI wants to quantify the amounts of <br />topsoil, overburden and shale stockpiles on the site with surveying to preclude <br />any mis- calculations; ASCI wants to be sure of a viable and operable mine and <br />reclamation plan for this site, under any realistic possible conditions, for the <br />remainder of the life of mining/reclamation activities; there is also an issue with <br />the Town of Erie and a "Legal Right to Enter" in which Erie will not be able to <br />address this right to enter (as they are a landowner in the permit area) for 2 -3 <br />weeks until their Special Council is able to review the document. ASCI will <br />submit the amendment application the week of June 4, 2012. <br />4. Possible Violation: Failure to follow the approved reclamation plan for this site <br />as currently on file with the DRMS. <br />Corrective Action: The operator will file an amendment to the permit that will <br />clarify the reclamation plan and account for the excavated shale stockpile and <br />other aspects of the reclamation plan and existing, proposed and post- mining <br />mining land -use activities. <br />See explanation given for 3., above. ASCI will submit the amendment <br />application the week of June 4, 2012. <br />5. Possible Violation: Failure to salvage topsoil. <br />Corrective Action: The operator will identify in the permit amendment how <br />sufficient topsoil will be obtained and preserved in order to adequately reclaim the <br />site. <br />
