OBSERVATIONS <br />PERMIT #: M- 2001 -106 <br />INSPECTOR'S INITIALS: TC1 <br />INSPECTION DATE: April 26, 2012 <br />This was a pre- operation inspection related to the pending conversion application from a 110c to a 112c permit <br />(CNO1). The Operator's representative (Melanie Bounds) was present for the inspection. The site is accessed <br />off of CR 543 approximately one half mile south of its marked intersection with U.S. Hwy 69 near the east end <br />of Gardner. The mine access road is shared with a separate operation (M -1985 -008, Leone Gardner Gravel site <br />operated by Hard Rock Paving and Redi Mix). The Orlando Pit is south and east of the Leone Gardner Gravel <br />site. Site access when not hauling material is via a two -wheel track parallel to the graveled access road. <br />Inspection: <br />Permit Boundary: The Permit sign and boundary markers were properly posted (Photo 1). The mine has been <br />developed to the practical limit based on its current permit boundary. This inspector walked the existing <br />northern permit boundary and the proposed permit boundaries with the Operator's representative. The fence <br />along the northern boundary is being undermined by the north pit wall excavations (Photo 2). This would <br />normally be cited as a problem, but as a possible corrective action would be to expand the affected area with a <br />permit revision, as is the reason for this inspection, the offsite impact is not cited. Should the proposed permit <br />conversion not be approved, this will be cited as a problem. It should be noted that the Conversion Application <br />Mine plan requires the pit be mined at a 3H:1 V slope to prevent this type of problem in the future. <br />Pit: There is a large stockpile of material in the pit (Photo 3). Ms. Bounds stated the County has a portable <br />crusher that is used to process material when needed. The crusher was not on site at the time of this inspection. <br />No exposed groundwater was observed in the pit. <br />Adjacent Lands: No structures, with the exception of fences, exist within 200 feet of the proposed expansion <br />boundary. The current expansion area is rangeland. No noxious weeds were observed in the pit or adjacent <br />area. <br />Current Stipulations: <br />There are no current stipulations. <br />Records: <br />• The previous inspection was conducted 10/23/2008. No problems were cited. <br />• The permit anniversary date is December 18. The operator is current with annual fees and reports <br />through 2011. <br />Bond: <br />No bond is required for this operation. <br />Recommendations: <br />The Division recommends the following tasks be completed by the Operator: <br />1. Take practical measures to stabilize the north pit wall until such time as the Conversion Application is <br />approved. After such time as the conversion is approved by the DRMS, lay back the pit walls to the <br />required 3H:1 V slope within 90 days to be in compliance with the proposed mine plan. <br />2. Should the Conversion Application be denied, the Operator shall backfill the pit slopes to 3H:1V and <br />begin reclamation. <br />Page 2 of 3 <br />
