All ponds were holding water and appeared stable in the photographs, with the exception of the <br />following: <br />- The photographs should evidence of recent disturbance along the south embankment of the 6MN sediment pond. <br />This is in the area of recent erosional repair work. This area will require seeding to aid in stability of the <br />embankment. <br />GENERAL MINE PLAN COMPLANCE: <br />One coal train was observed in the aerial photographs. <br />OTHER (SPECIFY): <br />This was an aerial inspection flown by Harry Ranney of the Colorado Division of Reclamation, Mining and Safety <br />(Division). Oblique aerial photographs were taken on May 21, 2012 and reviewed in the office by Jason Musick <br />of the Division on May 30, 2012. The site was dry and the weather was clear at the time of the inspection. <br />PROCESSING WASTE /COAL MINE WASTE PILES — Rule 4.10 and 4.11 Drainage Control; Surface <br />Stabilization; Placement: <br />The Refuse Disposal Area Expansion was observed in the photographs. This area was stable with a small amount <br />of refuse stockpiled near the toe of the pile and towards the middle of the pile.
