Division Reclamation. Mining, and Safety
1313 Sherman Street Room 215
Denver., Colorado B02
United States Department of Interior
Office of Surface Mining
Reclematien.and Enforcement
1999 Broadway St. Suite 3320
Denver, Colorado 80202 -3050
May 17, 2012
Re: The mining operations In Nucia, C olorado
To, Whom.It May. Conczrn:.This.is.a formal camplalM_. One.tn.atrag andadeath in. the. family., we. have all. been. brou
back to Nucla. This is the place I lived all my life and grew up. The property in which I lived has now been mined and
reclaimed West of 27 Road. None of this looks the same. There is now a 30 foot Mountain that was never there. This is
very much an eye sore. It should'have been returned like it was.
I have been taking pictures of the current operation and gpinj over facts. This is not being. done correctly, The earth
should be returned like it was. Why is this black spoil being brought to the top? .It does net belong there. Why is there
really nice red dirt being pushed off into the bottom of the pit? i tank pictures of all of this.
The Regulations are extensive end'hundrods ofpages. The rules that f know are the soils are to be returnedlike they
were. However they were naturally. Put it back as good as it was.
Wlian has topsoil been allowed be removedin a one lift operation ?' This has been happening since Fwas here last #ime
All soils must he segregated and all mines must do farm ground in a two -lift operation. What Regulation allows far them ,
ta.dmthi0
Also, going over some of this documentation. prior permits have not been in full compliance, San Miguel Power Property
did not even have a Right of Entry, How does the State control apiece of property that never had'a Righ aEntry to even
be mined? This is all a formal complaint and I would like an answer to.
Also. how is an operator allowed'to remove prime farmlend'soiis from a farm and'give it to another FarmT
1-think that. there are-many.violations.here.and.I know whatall.of this. loakad like. w hen. 1.grew up.. I.wishedI hadgotten
involved Ian efo a now, but some of these things are on ground violations that are happening right now.
&e P"
fir !!
/lei. /i/D rkc✓'os 3 Gil /} ' //
Ll$
