This was a Succession of Operator (SO) inspection for the purpose of determining if the current financial <br />warranty is adequate. The Operator's representative (Rusty Cochran) was present for the inspection. This site is <br />located approximately 6 l/ miles southeast of Pueblo, in Pueblo County. The site is accessed from Cortner <br />Road. <br />Inspection: <br />The Permit sign and boundary markers were properly posted (Photo 1). The site has not been actively mined <br />for several years, and reclamation is in process. Mr. Cochran indicated stockpiled material (Photo 2) is <br />occasionally sold and transported offsite. He also indicated Martin Marietta Materials intends to keep the <br />Cortner site active as a central location to set a scale house when the adjacent Beeman and Carter sites begin <br />mining operations. It should be noted that the Carter site does not have a permit. <br />The phase III area is graded, but not yet seeded (Photos 3 — 4). Some erosion gullies were observed on the <br />south slope of phase III. This is cited as a problem on page one of this report. There appeared to be some <br />tamarisk in the east end of phase III (Photo 4). The tamarisk is not cited as a problem, but should be controlled <br />as soon as possible to prevent an infestation. The south end of the phase II area has been graded and seeded <br />(Photos 5 and 2). <br />The drainage channels adjacent to the haul roads show severe erosion (no photos available). This is cited as a <br />problem on page 1 of this report. <br />Current Stipulations: <br />There are no current stipulations. <br />OBSERVATIONS <br />Records: <br />• The previous inspection was conducted 12/20/2007. <br />PERMIT #: M- 1986 -159 <br />INSPECTOR'S INITIALS: TC1 <br />INSPECTION DATE: April 10, 2012 <br />• The permit anniversary date is June 15. The operator is current with annual fees and reports through <br />June 2011. <br />• This is the fifth SO for the site. Lafarge SO'd the site from SO Western Mobile Southern, Inc. in 2002. <br />Bond: <br />The current $73,556 bond is considered adequate to cover the cost of reclamation. <br />Recommendations: <br />The Division recommends the following tasks be completed by the Operator: <br />1. The Operator shall take measures to control the erosion in the drainages adjacent to the haul roads <br />within 90 days of this report. <br />2. Remove the small amount of tamarisk in the east end of the phase III area. <br />3. Please add "MLRB Permit No. M- 1986 -159" to the entrance sign. <br />4. The Operator should note that if there is no mining related activity (this includes the sale of stockpiled <br />material) for 180 days or more, a request for Temporary Cessation should be submitted to the Division <br />pursuant to C.R.S. 34- 32.5 -103 (11) (b). <br />Page 2 of 4 <br />
