This was a Succession of Operator (SO) inspection for the purpose of determining if the current financial
warranty is adequate. The Operator's representative (Rusty Cochran) was present for the inspection. This site is
located approximately 6 l/ miles southeast of Pueblo, in Pueblo County. The site is accessed from Cortner
Road.
Inspection:
The Permit sign and boundary markers were properly posted (Photo 1). The site has not been actively mined
for several years, and reclamation is in process. Mr. Cochran indicated stockpiled material (Photo 2) is
occasionally sold and transported offsite. He also indicated Martin Marietta Materials intends to keep the
Cortner site active as a central location to set a scale house when the adjacent Beeman and Carter sites begin
mining operations. It should be noted that the Carter site does not have a permit.
The phase III area is graded, but not yet seeded (Photos 3 — 4). Some erosion gullies were observed on the
south slope of phase III. This is cited as a problem on page one of this report. There appeared to be some
tamarisk in the east end of phase III (Photo 4). The tamarisk is not cited as a problem, but should be controlled
as soon as possible to prevent an infestation. The south end of the phase II area has been graded and seeded
(Photos 5 and 2).
The drainage channels adjacent to the haul roads show severe erosion (no photos available). This is cited as a
problem on page 1 of this report.
Current Stipulations:
There are no current stipulations.
OBSERVATIONS
Records:
• The previous inspection was conducted 12/20/2007.
PERMIT #: M- 1986 -159
INSPECTOR'S INITIALS: TC1
INSPECTION DATE: April 10, 2012
• The permit anniversary date is June 15. The operator is current with annual fees and reports through
June 2011.
• This is the fifth SO for the site. Lafarge SO'd the site from SO Western Mobile Southern, Inc. in 2002.
Bond:
The current $73,556 bond is considered adequate to cover the cost of reclamation.
Recommendations:
The Division recommends the following tasks be completed by the Operator:
1. The Operator shall take measures to control the erosion in the drainages adjacent to the haul roads
within 90 days of this report.
2. Remove the small amount of tamarisk in the east end of the phase III area.
3. Please add "MLRB Permit No. M- 1986 -159" to the entrance sign.
4. The Operator should note that if there is no mining related activity (this includes the sale of stockpiled
material) for 180 days or more, a request for Temporary Cessation should be submitted to the Division
pursuant to C.R.S. 34- 32.5 -103 (11) (b).
