Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Colorado Division of Reclamation, Mining and Safety (Division) has reviewed the above referenced report. The first <br />quarter sediment pond inspection reports and the pond capacity data were received by the Division on April 5, 2012. <br />Sediment pond inspections were conducted by TMI on January 12, 2012. Several issues were identified and will need to be <br />addressed by TMI. <br />Rule 4.05.9(15)- Inspection Report Requirements: <br />Item (b) of this section requires the inspection report to indicate the existing storage capacity of the impoundment. There are <br />several discrepancies that must be clarified. <br />1.) On the "Impoundment Inspection — Pond Capacity Data" sheet submitted with the report, the I't Quarter estimated <br />sediment level for the Coyote Pond was 38 acre -feet. The total capacity of the pond is reported to be 75.1 acre -feet. Given <br />the estimated capacity of sediment in the pond, the % sediment should be about 50 %; however, the reported amount was 0 %. <br />Please correct this discrepancy. <br />2.) The report indicates 0% sediment contained in all of the impoundments. According to the 4th Quarter Sediment Pond <br />Inspection report the following ponds contained a percentage of sediment: Johnson #6, Johnson #7R, West Pyeatt #1, West <br />Pyeatt #2, Middle Pyeatt #1 and West Flume. These ponds had reportable levels of sediment in 2011. According to section <br />4.8.1.4 of the permit, sediment will be removed from the ponds once the capacity has reached 60 %. Given the reported % <br />sediment in 2011, these ponds had not reached the trigger point for sediment removal. It does not appear the sediment level <br />for the ponds has been accurately estimated during the I't quarter inspection. <br />Please review the procedure for estimating the sediment level of the impoundments and ensure the levels are reported <br />accurately in the 2nd quarter report.
