Lupton Sand and Gravel Mine, Permit No. M- 1999 -120 — Revised (CHS #61570) <br />Dear Mr. Scott: <br />Thank you for your follow -up correspondence dated March 28, 2012 (received by our office on March 30, 2012) <br />regarding the subject project. <br />A search of the Colorado Cultural Resource Inventory database indicates that several cultural resource <br />inventories have been conducted within or near the proposed permit area and a number of cultural properties <br />have been recorded including the Lupton Bottoms Ditch (site 5WL2652) which was determined eligible for the <br />National Register of Historic Places (NRHP). <br />We recommend that the operator avoid this site or that additional inventory be conducted to determine the <br />effect of the proposed project on this resource. If site avoidance is not possible, we recommend further <br />consultation with our office in order to identify options to avoid, minimize, or mitigate the adverse effect to the <br />sites. <br />Should human remains be discovered during mining activities the requirements under State law CRS 24 -80 part <br />13 apply and must be followed. <br />Thank you for the opportunity to comment.
