HISTORY
April 6, 2012
Eric C. Scott
Environmental Protection Specialist
Division of Reclamation, Mining and Safety
Department of Natural Resources
1313 Sherman Street, Room 215
Denver, Colorado 80203
Re: L.G. Everist, Inc., Ft. Lupton Sand and Gravel Mine, Permit No. M- 1999 -120 — Revised (CHS #61570)
Dear Mr. Scott:
Thank you for your follow -up correspondence dated March 28, 2012 (received by our office on March 30, 2012)
regarding the subject project.
A search of the Colorado Cultural Resource Inventory database indicates that several cultural resource
inventories have been conducted within or near the proposed permit area and a number of cultural properties
have been recorded including the Lupton Bottoms Ditch (site 5WL2652) which was determined eligible for the
National Register of Historic Places (NRHP).
We recommend that the operator avoid this site or that additional inventory be conducted to determine the
effect of the proposed project on this resource. If site avoidance is not possible, we recommend further
consultation with our office in order to identify options to avoid, minimize, or mitigate the adverse effect to the
sites.
Should human remains be discovered during mining activities the requirements under State law CRS 24 -80 part
13 apply and must be followed.
Thank you for the opportunity to comment. If we may be of further assistance, please contact Mark Tobias,
Section 106 Compliance Manager, at (303) 866 -4674 or mark. tobiasQstate.co.us.
Sincerely,
Edward C.
